Question before the Court
In what circumstances a contracting party may recover damages for losses sustained by its subsidiary rather than by the contracting party itself.
Why it matters
The Court rejected the proposed wider exception for transferred loss and confirmed that separate corporate personality cannot be bypassed through an undefined right to recover a subsidiary’s trading losses.
