Question before the Court

Why it matters

A significant appeal on arbitral remedies and state immunity arising from the long-running Prestige enforcement litigation.

Question before the Court

Whether a bankruptcy petition can be founded on a foreign judgment that has not first been recognised in England and Wales.

Why it matters

A leading cross-border insolvency decision on the use of foreign judgments as petition debts. Alexander appeared in the Court of Appeal consequential hearing; this entry comments on the later Supreme Court proceedings and does not suggest that he appeared there.
