How to use this page

Each entry is an original, concise research summary based on the Court’s official case record. Hearing dates may change. After a hearing, the official case page normally adds recordings; when judgment is delivered, it adds the judgment, neutral citation and press summary. Those materials remain on the Court’s website and are linked here rather than reproduced.

Question before the Court

Whether the English court could grant a final anti-suit injunction to enforce English-law arbitration agreements where Paris was the arbitral seat and proceedings had been brought in Russia.

Why it matters

The Supreme Court unanimously dismissed the appeal. It held that the arbitration agreements were governed by English law and that the foreign seat did not prevent the English court enforcing the contractual promise to arbitrate. Neither the French courts nor an arbitral tribunal could provide an effective remedy for the Russian proceedings, so the mandatory anti-suit injunction stood. A significant decision on governing law, jurisdiction and court support for international arbitration.
