How to use this page

Each entry is an original, concise research summary based on the Court’s official case record. Hearing dates may change. Oakwood Solicitors Ltd v Menzies

Question before the Court

Solicitors’ costs: payment by deduction and assessment time limits.

Why it matters

The Supreme Court unanimously allowed the client’s appeal. For the purposes of section 70 of the Solicitors Act 1974, general authority to deduct fees and delivery of a bill were insufficient to establish payment: agreement to the amount taken was required, which could in appropriate circumstances be inferred from conduct. The Court restored the order for assessment. Relevant to solicitor–client costs disputes and the time limits for challenging bills.
